Research use agreement

Important: This Research Use Agreement is a binding agreement between Prime Research Products Co., Ltd., trading as Prime Peptides Thailand ("Prime Peptides", "we", "us"), and the purchasing individual or entity ("Researcher", "you"). By placing or completing an order, you confirm that you have read, understood and accepted every provision below. If you do not agree, do not purchase or use the products.

1. Research use only: absolute restriction

Every product supplied by Prime Peptides is designated strictly for legitimate in-vitro laboratory research, analytical method development and scientific study. You expressly agree that you will:

• not administer, apply or otherwise introduce any product into or onto any human being or living animal, including by injection, ingestion, inhalation, topical application or any other route;
• not use any product for diagnostic, therapeutic, prophylactic, clinical, veterinary, cosmetic, household or personal purposes;
• not represent any product as a drug, medicine, supplement, cosmetic, therapeutic agent or product intended to affect the structure or function of a human or animal body; and
• not resell, distribute or transfer a product for human or veterinary use, self-administration or any purpose inconsistent with legitimate laboratory research.

2. Researcher qualifications

By purchasing, you represent and warrant that you:

• are at least 21 years old;
• are a qualified researcher or authorised representative of a laboratory, educational institution or other legitimate research organisation;
• have the scientific knowledge, training, facilities and safety procedures required to receive, handle, store, use and dispose of research materials responsibly;
• are purchasing solely for legitimate in-vitro laboratory research and not for personal use, clinical use, resale for a prohibited use or administration to any human or animal; and
• will restrict access to authorised and appropriately trained research personnel.

3. Compliance with law

You are solely responsible for determining whether the purchase, possession, importation, storage, handling, transfer, disposal and intended research use of a product are permitted in your jurisdiction. You must comply with all applicable Thai and local laws, regulations, institutional policies, laboratory standards and permit requirements.

Prime Peptides does not represent that any product is lawful or suitable for a particular jurisdiction, facility, protocol or intended use. A product listing, order acceptance or delivery is not legal or regulatory advice and does not transfer your compliance obligations to us.

4. Handling, storage and disposal

You agree to follow the product label, available batch documentation, laboratory safety procedures and all applicable rules relating to research materials. This includes using suitable personal protective equipment, maintaining secure and access-controlled storage, preventing unauthorised access, and disposing of products and packaging through appropriate laboratory or chemical-waste channels.

5. No medical, clinical or dosing advice

Nothing on this website, in product descriptions, Certificates of Analysis, test results, emails or other communications from Prime Peptides constitutes medical advice, clinical guidance, dosing information or a recommendation for human or veterinary use. Scientific and technical information is provided only as a reference for qualified researchers and must not be used to make health, treatment or self-administration decisions.

6. Regulatory status

Prime Peptides supplies research materials. It is not a pharmacy, medical clinic or compounding facility and does not provide medical or veterinary services. Products are not marketed as medicines, food supplements, cosmetics or therapeutic goods and have not been evaluated or approved by the Thai Food and Drug Administration for medical, therapeutic, diagnostic or human use.

7. Purchaser information and verification

You confirm that all information supplied during researcher verification, account registration and checkout is complete and accurate. You authorise Prime Peptides to request reasonable information needed to assess purchaser qualifications, intended research use or legal compliance. We may delay, refuse or cancel an order where information is incomplete, false, misleading or gives reasonable grounds to suspect a prohibited or unlawful use.

8. Assumption of risk

Research materials may present known and unknown hazards. To the fullest extent permitted by applicable law, you knowingly assume the risks arising from your receipt, handling, storage, research use, transfer and disposal of the products. You are responsible for your research design, safety assessment, facilities, personnel and compliance controls.

9. Limited warranty and responsibility

Prime Peptides warrants only that, at the time of dispatch, a product will materially correspond to its stated product identity and the batch documentation we publish for it, subject to the applicable acceptance criteria and any terms stated on the product page. You must inspect deliveries promptly and report suspected defects, damage or discrepancies in accordance with our Shipping & Refund Policy.

Except for rights and remedies that cannot lawfully be excluded, Prime Peptides disclaims implied warranties and is not responsible for results arising from unsuitable protocols, improper handling or storage, unauthorised use, alteration, contamination after delivery, or any use outside this Agreement.

10. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Prime Research Products Co., Ltd. and its directors, officers, employees and agents from third-party claims, losses, liabilities and reasonable costs arising from your breach of this Agreement, prohibited use or transfer of a product, violation of law, or negligent or wilful conduct. This provision does not limit liability that cannot lawfully be limited.

11. Suspension, refusal and reporting

We may suspend an account, refuse service or cancel an order where we reasonably believe that a product may be purchased, transferred or used contrary to this Agreement or applicable law. Where legally required, we may preserve records or provide information to competent authorities.

12. Related terms and entire agreement

This Agreement is incorporated into and must be read with our Terms of Service, Privacy Policy and Shipping & Refund Policy. Together, those documents form the entire agreement concerning the purchase and permitted use of Prime Peptides research products. If a specific product or order term conflicts with this Agreement, the stricter research-use restriction applies to the extent permitted by law.

13. Governing law, severability and updates

This Agreement is governed by the laws of Thailand. Disputes are subject to the jurisdiction of the competent courts of Thailand, except where applicable law requires otherwise. If any provision is held invalid or unenforceable, the remaining provisions continue in effect. The version presented at checkout applies to that order; we may update this Agreement prospectively by publishing a new effective date and version.

ข้อตกลงการใช้เพื่อการวิจัย

สำคัญ: ข้อตกลงการใช้เพื่อการวิจัยฉบับนี้เป็นข้อตกลงที่มีผลผูกพันระหว่าง Prime Research Products Co., Ltd. ซึ่งดำเนินกิจการภายใต้ชื่อ Prime Peptides Thailand (“Prime Peptides”, “เรา”) กับบุคคลหรือนิติบุคคลผู้ซื้อ (“นักวิจัย”, “ท่าน”) การสั่งซื้อหรือดำเนินการสั่งซื้อจนเสร็จสิ้นถือว่าท่านได้อ่าน เข้าใจ และยอมรับข้อกำหนดทุกข้อด้านล่างนี้แล้ว หากท่านไม่ยอมรับ กรุณาอย่าซื้อหรือใช้ผลิตภัณฑ์

1. การใช้เพื่อการวิจัยเท่านั้น — ข้อจำกัดเด็ดขาด

ผลิตภัณฑ์ทุกรายการที่ Prime Peptides จัดจำหน่าย กำหนดไว้สำหรับการวิจัยในห้องปฏิบัติการแบบในหลอดทดลอง (in vitro) การพัฒนาวิธีวิเคราะห์ และการศึกษาทางวิทยาศาสตร์ที่ชอบด้วยกฎหมายเท่านั้น ท่านตกลงโดยชัดแจ้งว่าท่านจะ:

• ไม่ให้ ไม่ใช้ และไม่นำผลิตภัณฑ์ใด ๆ เข้าสู่หรือทาลงบนร่างกายของมนุษย์หรือสัตว์ที่มีชีวิต ไม่ว่าโดยการฉีด การรับประทาน การสูดดม การทาภายนอก หรือโดยวิธีอื่นใด
• ไม่ใช้ผลิตภัณฑ์ใด ๆ เพื่อวัตถุประสงค์ในการวินิจฉัย การบำบัดรักษา การป้องกันโรค ทางคลินิก ทางสัตวแพทย์ เครื่องสำอาง ใช้ในครัวเรือน หรือใช้ส่วนบุคคล
• ไม่แสดงหรือกล่าวอ้างว่าผลิตภัณฑ์ใด ๆ เป็นยา เวชภัณฑ์ ผลิตภัณฑ์เสริมอาหาร เครื่องสำอาง สารบำบัดรักษา หรือผลิตภัณฑ์ที่มุ่งให้มีผลต่อโครงสร้างหรือการทำงานของร่างกายมนุษย์หรือสัตว์ และ
• ไม่ขายต่อ ไม่จำหน่าย และไม่ส่งมอบผลิตภัณฑ์เพื่อใช้กับมนุษย์หรือสัตว์ เพื่อการใช้ด้วยตนเอง หรือเพื่อวัตถุประสงค์ใดที่ขัดต่อการวิจัยในห้องปฏิบัติการที่ชอบด้วยกฎหมาย

2. คุณสมบัติของนักวิจัย

การซื้อผลิตภัณฑ์ถือว่าท่านรับรองและรับประกันว่าท่าน:

• มีอายุไม่ต่ำกว่า 21 ปี
• เป็นนักวิจัยที่มีคุณสมบัติ หรือเป็นผู้แทนที่ได้รับมอบอำนาจจากห้องปฏิบัติการ สถาบันการศึกษา หรือองค์กรวิจัยที่ชอบด้วยกฎหมาย
• มีความรู้ทางวิทยาศาสตร์ การฝึกอบรม สถานที่ และขั้นตอนความปลอดภัยที่จำเป็นต่อการรับ การจัดการ การจัดเก็บ การใช้ และการกำจัดวัสดุสำหรับการวิจัยอย่างรับผิดชอบ
• ซื้อเพื่อการวิจัยในห้องปฏิบัติการแบบในหลอดทดลองที่ชอบด้วยกฎหมายเท่านั้น มิใช่เพื่อใช้ส่วนบุคคล ใช้ทางคลินิก ขายต่อเพื่อการใช้ต้องห้าม หรือให้แก่มนุษย์หรือสัตว์ และ
• จะจำกัดการเข้าถึงเฉพาะบุคลากรวิจัยที่ได้รับอนุญาตและผ่านการฝึกอบรมอย่างเหมาะสม

3. การปฏิบัติตามกฎหมาย

ท่านมีหน้าที่รับผิดชอบแต่เพียงผู้เดียวในการพิจารณาว่าการซื้อ การครอบครอง การนำเข้า การจัดเก็บ การจัดการ การส่งมอบ การกำจัด และการใช้เพื่อการวิจัยตามที่ประสงค์นั้น เป็นสิ่งที่กระทำได้ในเขตอำนาจของท่านหรือไม่ ท่านต้องปฏิบัติตามกฎหมายไทยและกฎหมายท้องถิ่น กฎระเบียบ นโยบายของสถาบัน มาตรฐานห้องปฏิบัติการ และข้อกำหนดเรื่องใบอนุญาตที่เกี่ยวข้องทั้งหมด

Prime Peptides ไม่ได้รับรองว่าผลิตภัณฑ์ใดชอบด้วยกฎหมายหรือเหมาะสมกับเขตอำนาจ สถานที่ โปรโตคอล หรือการใช้งานที่ประสงค์ใดโดยเฉพาะ การแสดงรายการผลิตภัณฑ์ การรับคำสั่งซื้อ หรือการจัดส่ง ไม่ถือเป็นคำแนะนำทางกฎหมายหรือด้านกฎระเบียบ และไม่เป็นการโอนภาระหน้าที่ในการปฏิบัติตามกฎหมายของท่านมายังเรา

4. การจัดการ การจัดเก็บ และการกำจัด

ท่านตกลงที่จะปฏิบัติตามฉลากผลิตภัณฑ์ เอกสารประจำรุ่นการผลิตที่มีให้ ขั้นตอนความปลอดภัยของห้องปฏิบัติการ และกฎเกณฑ์ที่เกี่ยวข้องทั้งหมดว่าด้วยวัสดุสำหรับการวิจัย ซึ่งรวมถึงการใช้อุปกรณ์ป้องกันส่วนบุคคลที่เหมาะสม การจัดเก็บอย่างปลอดภัยและมีการควบคุมการเข้าถึง การป้องกันการเข้าถึงโดยไม่ได้รับอนุญาต และการกำจัดผลิตภัณฑ์และบรรจุภัณฑ์ผ่านช่องทางกำจัดของเสียทางห้องปฏิบัติการหรือทางเคมีที่เหมาะสม

5. ไม่ใช่คำแนะนำทางการแพทย์ ทางคลินิก หรือเรื่องขนาดการใช้

ไม่มีข้อความใดในเว็บไซต์นี้ ในคำอธิบายผลิตภัณฑ์ ใบรับรองผลการวิเคราะห์ ผลการตรวจสอบ อีเมล หรือการสื่อสารอื่นใดจาก Prime Peptides ที่ถือเป็นคำแนะนำทางการแพทย์ แนวทางทางคลินิก ข้อมูลขนาดการใช้ หรือคำแนะนำให้ใช้กับมนุษย์หรือสัตว์ ข้อมูลทางวิทยาศาสตร์และทางเทคนิคจัดให้เพื่อเป็นข้อมูลอ้างอิงสำหรับนักวิจัยที่มีคุณสมบัติเท่านั้น และต้องไม่นำไปใช้ในการตัดสินใจเกี่ยวกับสุขภาพ การรักษา หรือการใช้ด้วยตนเอง

6. สถานะทางกฎหมายและกฎระเบียบ

Prime Peptides จัดจำหน่ายวัสดุสำหรับการวิจัย มิใช่ร้านขายยา คลินิกทางการแพทย์ หรือสถานที่ผสมยา และไม่ได้ให้บริการทางการแพทย์หรือทางสัตวแพทย์ ผลิตภัณฑ์ไม่ได้ทำการตลาดในฐานะยา ผลิตภัณฑ์เสริมอาหาร เครื่องสำอาง หรือผลิตภัณฑ์เพื่อการบำบัดรักษา และไม่ได้รับการประเมินหรืออนุมัติจากสำนักงานคณะกรรมการอาหารและยา (อย.) ประเทศไทย เพื่อใช้ทางการแพทย์ การบำบัดรักษา การวินิจฉัย หรือใช้กับมนุษย์

7. ข้อมูลผู้ซื้อและการตรวจสอบยืนยัน

ท่านยืนยันว่าข้อมูลทั้งหมดที่ให้ไว้ระหว่างการยืนยันสถานะนักวิจัย การลงทะเบียนบัญชี และการชำระเงินนั้นครบถ้วนและถูกต้อง ท่านอนุญาตให้ Prime Peptides ร้องขอข้อมูลตามสมควรที่จำเป็นต่อการประเมินคุณสมบัติของผู้ซื้อ วัตถุประสงค์การใช้เพื่อการวิจัย หรือการปฏิบัติตามกฎหมาย เราอาจชะลอ ปฏิเสธ หรือยกเลิกคำสั่งซื้อ หากข้อมูลไม่ครบถ้วน เป็นเท็จ ทำให้เข้าใจผิด หรือมีเหตุอันควรสงสัยว่าจะมีการใช้ที่ต้องห้ามหรือไม่ชอบด้วยกฎหมาย

8. การยอมรับความเสี่ยง

วัสดุสำหรับการวิจัยอาจมีอันตรายทั้งที่ทราบและไม่ทราบ ภายใต้ขอบเขตสูงสุดที่กฎหมายที่ใช้บังคับอนุญาต ท่านยอมรับโดยรู้สำนึกซึ่งความเสี่ยงที่เกิดจากการรับ การจัดการ การจัดเก็บ การใช้เพื่อการวิจัย การส่งมอบ และการกำจัดผลิตภัณฑ์ ท่านเป็นผู้รับผิดชอบต่อการออกแบบการวิจัย การประเมินความปลอดภัย สถานที่ บุคลากร และมาตรการควบคุมการปฏิบัติตามกฎหมายของท่านเอง

9. การรับประกันและความรับผิดชอบอย่างจำกัด

Prime Peptides รับประกันเพียงว่า ณ เวลาที่จัดส่ง ผลิตภัณฑ์จะสอดคล้องในสาระสำคัญกับอัตลักษณ์ของผลิตภัณฑ์ตามที่ระบุ และกับเอกสารประจำรุ่นการผลิตที่เราเผยแพร่สำหรับผลิตภัณฑ์นั้น ทั้งนี้ขึ้นอยู่กับเกณฑ์การยอมรับที่เกี่ยวข้องและข้อกำหนดใด ๆ ที่ระบุไว้ในหน้าผลิตภัณฑ์ ท่านต้องตรวจสอบสินค้าที่ได้รับโดยพลัน และแจ้งข้อบกพร่อง ความเสียหาย หรือความคลาดเคลื่อนที่สงสัย ตามนโยบายการจัดส่งและการคืนเงินของเรา

เว้นแต่สิทธิและการเยียวยาที่ไม่อาจยกเว้นได้โดยชอบด้วยกฎหมาย Prime Peptides ขอปฏิเสธการรับประกันโดยปริยาย และไม่รับผิดชอบต่อผลลัพธ์ที่เกิดจากโปรโตคอลที่ไม่เหมาะสม การจัดการหรือการจัดเก็บที่ไม่ถูกต้อง การใช้โดยไม่ได้รับอนุญาต การดัดแปลง การปนเปื้อนภายหลังการส่งมอบ หรือการใช้ใด ๆ นอกเหนือจากข้อตกลงฉบับนี้

10. การชดใช้ค่าเสียหาย

ภายใต้ขอบเขตสูงสุดที่กฎหมายที่ใช้บังคับอนุญาต ท่านตกลงที่จะชดใช้ค่าเสียหายและปกป้อง Prime Research Products Co., Ltd. ตลอดจนกรรมการ เจ้าหน้าที่ พนักงาน และตัวแทนของบริษัท จากข้อเรียกร้องของบุคคลภายนอก ความสูญเสีย ความรับผิด และค่าใช้จ่ายตามสมควร อันเกิดจากการที่ท่านผิดข้อตกลงฉบับนี้ การใช้หรือการส่งมอบผลิตภัณฑ์ที่ต้องห้าม การฝ่าฝืนกฎหมาย หรือการกระทำโดยประมาทเลินเล่อหรือโดยจงใจ ข้อกำหนดนี้ไม่จำกัดความรับผิดที่ไม่อาจจำกัดได้โดยชอบด้วยกฎหมาย

11. การระงับ การปฏิเสธ และการรายงาน

เราอาจระงับบัญชี ปฏิเสธการให้บริการ หรือยกเลิกคำสั่งซื้อ หากเรามีเหตุอันควรเชื่อว่าผลิตภัณฑ์อาจถูกซื้อ ส่งมอบ หรือใช้โดยขัดต่อข้อตกลงฉบับนี้หรือกฎหมายที่ใช้บังคับ ในกรณีที่กฎหมายกำหนด เราอาจเก็บรักษาบันทึกหรือให้ข้อมูลแก่หน่วยงานที่มีอำนาจ

12. ข้อกำหนดที่เกี่ยวข้องและความสมบูรณ์ของข้อตกลง

ข้อตกลงฉบับนี้ถือเป็นส่วนหนึ่งของและต้องอ่านประกอบกับข้อกำหนดในการให้บริการ นโยบายความเป็นส่วนตัว และนโยบายการจัดส่งและการคืนเงินของเรา เอกสารทั้งหมดนี้รวมกันถือเป็นข้อตกลงทั้งหมดเกี่ยวกับการซื้อและการใช้ผลิตภัณฑ์เพื่อการวิจัยของ Prime Peptides ที่ได้รับอนุญาต หากข้อกำหนดของผลิตภัณฑ์หรือคำสั่งซื้อใดขัดแย้งกับข้อตกลงฉบับนี้ ให้ใช้ข้อจำกัดการใช้เพื่อการวิจัยที่เข้มงวดกว่าเท่าที่กฎหมายอนุญาต

13. กฎหมายที่ใช้บังคับ การแยกส่วนของข้อกำหนด และการปรับปรุง

ข้อตกลงฉบับนี้อยู่ภายใต้บังคับของกฎหมายแห่งราชอาณาจักรไทย ข้อพิพาทอยู่ในเขตอำนาจของศาลไทยที่มีอำนาจ เว้นแต่กฎหมายที่ใช้บังคับจะกำหนดไว้เป็นอย่างอื่น หากข้อกำหนดใดตกเป็นโมฆะหรือไม่อาจบังคับใช้ได้ ข้อกำหนดที่เหลือยังคงมีผลบังคับใช้ต่อไป ฉบับที่แสดง ณ ขั้นตอนการชำระเงินให้ใช้บังคับกับคำสั่งซื้อนั้น เราอาจปรับปรุงข้อตกลงฉบับนี้ในอนาคตโดยการเผยแพร่วันที่มีผลบังคับใช้และหมายเลขเวอร์ชันใหม่
